China's Civil Code Update Changes How Property Splits in Divorce

An update to China's Civil Code has fundamentally shifted how assets are divided during a divorce. Moving away from the traditional 50/50 split, marital property is now primarily distributed based on who paid for it and whose name is on the title. For instance, a home purchased by one spouse before marriage remains their separate property, even if the other's name is added later, unless financial contribution can be proven.

The legal reform also features a 30-day cooling-off period and eliminates spousal alimony entirely. Supporters argue that the new rules deter impulsive divorces and fairly reward actual financial contribution. Conversely, critics warn it leaves stay-at-home spouses financially vulnerable. 

This major shift has sparked intense global debate over property rights, fairness, and the changing dynamics of modern marriage.
